These Terms of Service ("Terms") govern your use of the WayliLoc mobile application and related services (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Eligibility & Child Mode
You must be at least 13 years old to use WayliLoc on your own, and users under 18 must have the consent of a parent or legal guardian.
Children under 13 may use WayliLoc only through Child Mode, a parent-managed feature. A child can be connected only through a code issued specifically for that purpose: on their own device the adult opens "Add child", is shown exactly what will be collected from the child's phone, and confirms that they are the child's parent or legal guardian — or that they act with the guardian's permission — and that they consent to that collection. A regular circle code cannot be used to connect a child. We record each such confirmation. A child's account is anonymous (no email, no password, no social login) and is created, managed, and deleted by the parent. The child can always see who is connected to them and can disconnect any of them directly from their own device, as long as at least one parent or guardian remains connected; multiple parents or guardians may be linked to one child, and they cannot see one another. Whenever someone new connects to the child, everyone already connected is notified. Disconnecting the last parent permanently deletes the child's account and location history.
Parental responsibility. If you set up or use Child Mode, you represent and warrant that (a) you are the parent or legal guardian of the child, (b) you have the authority to consent, on that child's behalf, to the collection and sharing of their location through the Service, and (c) you will obtain any additional consent required by the laws that apply to you. You are solely responsible for your use of Child Mode and for complying with all applicable laws, including children's-privacy laws such as COPPA and GDPR-K. You agree not to use Child Mode — or any other part of the Service — to locate or monitor anyone who is not your own minor child, or another person who has given you their informed, ongoing consent.
Child Mode is also subject to the SOS and service disclaimers below and to our Privacy Policy. By using the Service you confirm that you meet these requirements, and you agree to defend and indemnify us (see Section 13) against any claim arising from your setup or use of Child Mode, including any claim that you lacked the right or the consent to locate a child through the Service.
2. Account
You are responsible for keeping your login credentials secure and for all activity that happens under your account. Notify us immediately at support@wayliloc.com if you suspect unauthorized access.
3. Subscription Tiers
WayliLoc offers four service tiers. Pricing is shown inside the app at the moment of purchase and may vary by country.
- Free — 1 connected person, 1 geofence, location history kept for 3 days, GPS update interval fixed at 30 minutes.
- Basic — 5 connected people, 10 geofences, geofence arrival / leave alerts, full address lookup, the "I'm here" button to share your current location straight away, a choice of GPS interval (10 / 15 / 20 / 25 / 30 minutes), and location & alert history kept for 30 days.
- Standard — 10 connected people, 20 geofences, everything in Basic plus the SOS button with real-time tracking (up to 2 hours per day) and SOS / location push notifications.
- Premium — 20 connected people, 40 geofences, everything in Standard plus a larger SOS allowance (up to 4 hours per day), turn-by-turn navigation, routes with live traffic, trip history, saved places on the map, and address search for routes.

If you are on Free and someone with a paid plan follows you, part of their plan applies to your account automatically, for as long as that connection is active and without any payment from you. What you get depends on their plan:
- Follower on Basic — your location history is kept 30 days instead of 3; your position is saved automatically at a shorter interval instead of once every 30 minutes; the "I'm here" button lets you share your current location straight away; and addresses are shown in full alongside coordinates.
- Follower on Standard — everything above, plus the SOS button with real-time tracking of up to 2 hours a day.
- Follower on Premium — everything above, with the larger SOS allowance of up to 4 hours a day.
If several people follow you, the highest of their plans applies. These benefits stop as soon as the last paid connection is removed, and your own limits — how many people you can follow and how many zones you can create — do not change. Trip history and saved places are never shared this way: they always require your own Premium plan.
4. Free Trial (Premium Intro Offer)
Paid plans may include a free introductory offer through Apple's Intro Offer (or the equivalent on Google Play). The exact length and price are always shown by the App Store or Google Play at the moment of purchase. During the trial you get the feature set of the plan you selected.
To keep the free trial sustainable, a few of the most infrastructure-heavy actions have daily fair-use limits during the trial only. If you reach one, the app tells you; the limits reset daily and no longer apply once your paid plan begins.
When the trial ends, your selected paid plan begins automatically unless you cancel at least 24 hours before it ends, in line with App Store and Google Play rules.
5. Billing & Auto-Renewal
- Subscriptions are billed through the Apple App Store or Google Play and auto-renew unless cancelled at least 24 hours before the current period ends.
- You can switch between paid plans inside WayliLoc — the change takes effect immediately and the unused time on your previous plan is credited toward the new one. Cancelling a subscription is done in the device's store settings.
- Prices may change. We will notify you in advance of price increases before they take effect.
6. Refunds
Refunds are processed by Apple App Store / Google Play according to their respective refund policies. We do not directly process refunds. To request a refund:

7. What Happens When Your Subscription Ends
If you cancel or your paid subscription expires:
- You keep Premium-level features until the end of the period you have already paid for.
- After that period ends, your account switches to the Free tier in the app, but your data (geofences, location history, connections) is kept for a 30-day grace period in case you resubscribe.
- After the 30-day grace period, data that exceeds Free-tier limits is trimmed: geofences beyond the Free limit are removed and older history is deleted — but your account itself stays active, so you can pick up again at any time.
- Connections (people you follow) above your new limit are hidden, not deleted; on the Free tier the app shows only your most recent connection. They come back as soon as you upgrade within the 30-day grace period — after that period the hidden ones are removed. Saved places and trip history are Premium features: access stops as soon as you leave Premium, and if you do not return within the grace period they are deleted.
8. Acceptable Use
You agree NOT to:
- Use the Service to track any person without their full and informed consent.
- Use the Service for stalking, harassment, domestic abuse, or any unlawful surveillance.
- Resell, sublicense, or commercially exploit access to the Service.
- Attempt to circumvent subscription limits, modify the app binary, or interfere with our backend systems.
We may suspend or terminate accounts that violate these rules without prior notice (see Section 9).
9. Account Suspension & Termination
We reserve the right, at our sole discretion, to issue a warning, temporarily suspend, or permanently terminate (ban) any account, with or without prior notice, if we reasonably believe a user has engaged in any of the following:
- Tracking or monitoring any person without their full, informed, and ongoing consent.
- Stalking, harassment, intimidation, domestic abuse, or any unlawful surveillance of another person.
- Fraudulent, disputed, or charged-back payments, or any attempt to obtain paid features without paying.
- Creating multiple or fake accounts to evade subscription limits, suspensions, or bans.
- Impersonating another person or entity, or providing false identity information.
- Reverse-engineering, decompiling, scraping, using bots or automated access, or attempting to probe, attack, overload, or otherwise interfere with our backend, APIs, or other users.
- Uploading, storing, or transmitting illegal, infringing, or harmful content, including in profile names or avatars.
- Reselling, sublicensing, sharing, or transferring account access or credentials.
- Using the Service for any illegal purpose or in violation of any applicable law.
- Any conduct that, in our reasonable judgment, harms other users, third parties, or the integrity, security, or reputation of the Service.
Consequences may escalate from a warning, to temporary suspension, to permanent termination, depending on the severity of the violation. We may act immediately and without notice where we believe there is a risk to the safety of any person, to other users, or to the Service.
If your account is terminated for a violation of these Terms, you are not entitled to any refund of fees already paid, and you may be barred from creating a new account. Where required or permitted by law, we may preserve and disclose relevant data to law-enforcement authorities. Termination does not relieve you of any obligations or liabilities accrued before termination.
10. SOS Disclaimer
WayliLoc's SOS feature is a supplementary tool for sharing your location with trusted contacts. An SOS may also broadcast live microphone audio to those contacts while the SOS is active. Broadcasting is always started by the person raising the SOS — contacts cannot open your microphone remotely, and audio is never sent outside an active SOS. It is not a substitute for official emergency services (112, 911, 102, etc.). In an actual emergency, always call your local emergency number first. We accept no liability for delays, missed notifications, or inability to deliver SOS signals due to network conditions, device state, or other technical factors outside our control.
11. Disclaimers & "As Is" Service
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. To the maximum extent permitted by law, we do not warrant that:
- location data, routes, or addresses will be accurate, complete, or available at all times — GPS, Wi-Fi, and cellular positioning are inherently approximate and depend on your device and environment;
- the Service will be uninterrupted, timely, secure, or error-free;
- notifications (including SOS, geofence, and location alerts) will always be delivered, or delivered without delay;
- third-party services we rely on (such as map, hosting, push-notification, analytics, and payment providers) will be available or function without interruption.
You acknowledge that you use the Service, and rely on any location data or notifications, at your own risk.
12. Limitation of Liability
To the maximum extent permitted by law, WayliLoc and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or location accuracy, arising out of or in connection with your use of the Service.
In no event will our total aggregate liability to you for all claims arising out of or relating to the Service or these Terms exceed the greater of (a) the total amount you paid us, if any, in the twelve (12) months immediately before the event giving rise to the claim, or (b) USD $100. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
13. Indemnification
You agree to defend, indemnify, and hold harmless WayliLoc and its operators, owners, and affiliates from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the Service; (b) your violation of these Terms or of any applicable law; (c) your tracking or monitoring of any person without that person's consent, including any child you connect through Child Mode; or (d) your violation of the rights of any third party. We may assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.
14. Changes to Service or Terms
We may modify the Service and these Terms at any time. Significant changes will be announced via in-app notice or email. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
15. Governing Law & Dispute Resolution
These Terms, and any dispute arising out of or in connection with them, are governed by the laws of Spain, without regard to its conflict-of-law rules. If you are a consumer habitually resident in the European Union, you additionally enjoy the protection of the mandatory provisions of the law of your country of residence, and nothing in these Terms affects those rights.
Subject to the above, the courts of Spain shall have jurisdiction over any dispute relating to these Terms or the Service; as a consumer, you may also be entitled to bring proceedings in the courts of your country of residence.
Before pursuing any formal claim, you agree to first contact us at support@wayliloc.com and attempt to resolve the matter informally. We will try in good faith to resolve any dispute within 60 days of receiving your written notice — most concerns can be settled this way without formal proceedings. To the extent permitted by applicable law, you agree to pursue any unresolved claim individually and not as part of a class, collective, or representative action.
16. General Provisions
- Severability: If any provision of these Terms is held invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.
- No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
- Assignment: You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms, in whole or in part, at any time without notice, including in connection with a merger, acquisition, or sale of assets.
- Force Majeure: We are not liable for any failure or delay caused by events beyond our reasonable control, including natural disasters, war, terrorism, labour disputes, government action, power or network failures, or failures of third-party providers.
- Survival: Provisions that by their nature should survive — including Sections 9–13 (suspension, disclaimers, liability, indemnification), Dispute Resolution, and these General Provisions — will survive termination of your account or these Terms.
