These Terms of Service ("Terms") govern your use of the WayliLoc mobile application and related services (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Eligibility
You must be at least 13 years old to use WayliLoc. Users under 18 must have parental consent. By using the Service you confirm that you meet these requirements.
2. Account
You are responsible for keeping your login credentials secure and for all activity that happens under your account. Notify us immediately at support@wayliloc.com if you suspect unauthorized access.
3. Subscription Tiers
WayliLoc offers four service tiers. Pricing is shown inside the app at the moment of purchase and may vary by country.
- Free — 2 connected users, 1 geofence, location history retained for 3 days, geofence push notifications, GPS interval fixed at 30 minutes.
- Basic — 5 connected users, 3 geofences, full address lookup, configurable GPS interval (10/15/20/25/30 minutes), location and alerts history retained for 30 days.
- Standard — 10 connected users, 10 geofences, all Basic features plus SOS button (2 hours per day) and SOS / location push notifications.
- Premium — Unlimited connected users and geofences, all Standard features plus turn-by-turn navigation, routes with live traffic, and the highest level of support.

4. Free Trial (Premium Intro Offer)
Premium subscribers may be eligible for a 7-day free trial via Apple's Intro Offer. During the trial period the following per-day usage caps apply to control infrastructure costs:
- SOS live tracking: up to 10 minutes per day
- Traffic-enabled routes: up to 30 requests per day
- Address lookups (reverse geocoding): up to 30 requests per day
All caps reset daily at 00:00 local time. After the 7-day trial, your selected paid plan begins automatically unless you cancel at least 24 hours before the trial ends, in line with App Store rules.
5. Billing & Auto-Renewal
- Subscriptions are billed through the Apple App Store or Google Play and auto-renew unless cancelled at least 24 hours before the current period ends.
- You manage and cancel subscriptions in the device's store settings, not inside WayliLoc.
- Prices may change. We will notify you in advance of price increases before they take effect.
6. Refunds
Refunds are processed by Apple App Store / Google Play according to their respective refund policies. We do not directly process refunds. To request a refund:

7. What Happens When Your Subscription Ends
If you cancel or your paid subscription expires:
- You retain Premium-level features until the end of the period you have already paid for.
- After the period ends, your account moves to Free tier in the user interface, but your data (geofences, location history, connections) is preserved for a 90-day grace period in case you renew.
- After the 90-day grace, any data that exceeds Free-tier limits is automatically trimmed: extra geofences beyond the Free limit are deleted, older history is removed, but your account itself stays active so you can resume any time.
- Connections (people you track) are never automatically deleted; on Free tier you will see only your first 2 connections in the UI, the rest become visible again as soon as you upgrade.
8. Acceptable Use
You agree NOT to:
- Use the Service to track any person without their full and informed consent.
- Use the Service for stalking, harassment, domestic abuse, or any unlawful surveillance.
- Resell, sublicense, or commercially exploit access to the Service.
- Attempt to circumvent subscription limits, modify the app binary, or interfere with our backend systems.
- Submit fake SOS signals or otherwise abuse the emergency feature.
We may suspend or terminate accounts that violate these rules without prior notice (see Section 9).
9. Account Suspension & Termination
We reserve the right, at our sole discretion, to issue a warning, temporarily suspend, or permanently terminate (ban) any account, with or without prior notice, if we reasonably believe a user has engaged in any of the following:
- Tracking or monitoring any person without their full, informed, and ongoing consent.
- Stalking, harassment, intimidation, domestic abuse, or any unlawful surveillance of another person.
- Submitting false SOS signals or otherwise abusing the emergency feature.
- Fraudulent, disputed, or charged-back payments, or any attempt to obtain paid features without paying.
- Creating multiple or fake accounts to evade subscription limits, suspensions, or bans.
- Impersonating another person or entity, or providing false identity information.
- Reverse-engineering, decompiling, scraping, using bots or automated access, or attempting to probe, attack, overload, or otherwise interfere with our backend, APIs, or other users.
- Uploading, storing, or transmitting illegal, infringing, or harmful content, including in profile names or avatars.
- Reselling, sublicensing, sharing, or transferring account access or credentials.
- Using the Service for any illegal purpose or in violation of any applicable law.
- Any conduct that, in our reasonable judgment, harms other users, third parties, or the integrity, security, or reputation of the Service.
Consequences may escalate from a warning, to temporary suspension, to permanent termination, depending on the severity of the violation. We may act immediately and without notice where we believe there is a risk to the safety of any person, to other users, or to the Service.
If your account is terminated for a violation of these Terms, you are not entitled to any refund of fees already paid, and you may be barred from creating a new account. Where required or permitted by law, we may preserve and disclose relevant data to law-enforcement authorities. Termination does not relieve you of any obligations or liabilities accrued before termination.
10. SOS Disclaimer
WayliLoc's SOS feature is a supplementary tool for sharing your location with trusted contacts. It is not a substitute for official emergency services (112, 911, 102, etc.). In an actual emergency, always call your local emergency number first. We accept no liability for delays, missed notifications, or inability to deliver SOS signals due to network conditions, device state, or other technical factors outside our control.
11. Disclaimers & "As Is" Service
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. To the maximum extent permitted by law, we do not warrant that:
- location data, routes, or addresses will be accurate, complete, or available at all times — GPS, Wi-Fi, and cellular positioning are inherently approximate and depend on your device and environment;
- the Service will be uninterrupted, timely, secure, or error-free;
- notifications (including SOS, geofence, and location alerts) will always be delivered, or delivered without delay;
- third-party services we rely on (such as map, hosting, push-notification, analytics, and payment providers) will be available or function without interruption.
You acknowledge that you use the Service, and rely on any location data or notifications, at your own risk.
12. Limitation of Liability
To the maximum extent permitted by law, WayliLoc and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or location accuracy, arising out of or in connection with your use of the Service.
In no event will our total aggregate liability to you for all claims arising out of or relating to the Service or these Terms exceed the greater of (a) the total amount you paid us, if any, in the twelve (12) months immediately before the event giving rise to the claim, or (b) USD $100. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
13. Indemnification
You agree to defend, indemnify, and hold harmless WayliLoc and its operators, owners, and affiliates from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the Service; (b) your violation of these Terms or of any applicable law; (c) your tracking or monitoring of any person without that person's consent; or (d) your violation of the rights of any third party. We may assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.
14. Changes to Service or Terms
We may modify the Service and these Terms at any time. Significant changes will be announced via in-app notice or email. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
15. Governing Law & Dispute Resolution
These Terms, and any dispute arising out of or in connection with them, are governed by the laws of Poland, without regard to its conflict-of-law rules. If you are a consumer habitually resident in the European Union, you additionally enjoy the protection of the mandatory provisions of the law of your country of residence, and nothing in these Terms affects those rights.
Subject to the above, the courts of Poland shall have jurisdiction over any dispute relating to these Terms or the Service; as a consumer, you may also be entitled to bring proceedings in the courts of your country of residence.
Before pursuing any formal claim, you agree to first contact us at support@wayliloc.com and attempt to resolve the matter informally. We will try in good faith to resolve any dispute within 60 days of receiving your written notice — most concerns can be settled this way without formal proceedings. To the extent permitted by applicable law, you agree to pursue any unresolved claim individually and not as part of a class, collective, or representative action.
16. General Provisions
- Severability: If any provision of these Terms is held invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.
- No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
- Assignment: You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms, in whole or in part, at any time without notice, including in connection with a merger, acquisition, or sale of assets.
- Force Majeure: We are not liable for any failure or delay caused by events beyond our reasonable control, including natural disasters, war, terrorism, labour disputes, government action, power or network failures, or failures of third-party providers.
- Survival: Provisions that by their nature should survive — including Sections 9–13 (suspension, disclaimers, liability, indemnification), Dispute Resolution, and these General Provisions — will survive termination of your account or these Terms.
